NMB to Investigate Delta

June 6, 2011 — The National Mediation Board (NMB) today announced it is launching a full investigation into Delta Airline’s interference in last year’s IAM representation elections for the airline’s Fleet Service, Customer Service and Stores employees.

“After reviewing the submissions provided by lAM and Delta, I find that in order for the Board to determine whether the laboratory conditions were tainted, further investigation is needed,” said NMB General Counsel Mary Johnson in her notice to the parties.

“The IAM asked for and welcomes this investigation so the breadth of Delta’s illegal actions can be exposed and employees can finally vote free from Delta’s interference,” said IAM General Vice President Robert Roach, Jr.

If the NMB determines Delta engaged in election interference, the elections could be re-run

IAM Issues Update To Delta Workers on NMB Investigation StatusDear Delta Air Lines Employee:
May 20, 2011 — As we enter yet another series of representation elections brought about by industry consolidation, we continue to await a ruling on our charges of election interference against Delta currently pending before the Board. Delta has repeatedly requested filing extensions in their ongoing effort to stall this process and unduly influence your vote through delay and frustration.

The IAM and Delta have finally completed their respective submissions to the Board, and the Board must now weigh the evidence before it determines whether, based upon that evidence, a full investigation of the charges is warranted.  We believe it will be clear Delta purposely interfered, influenced and coerced thousands of eligible voters before, during and after the representation elections. Should the Board agree with us, they will launch a full scale investigation of the charges and allegations.

In the meantime, the IAM continues to investigate our concerns about Delta failing to abide by its obligations to its employees.  In that regard, the IAM is working to investigate the pre-merger NWA employees' profit sharing distribution.  We will update you as soon as this review is complete.We have and will continue to support your grassroots efforts with the resources of the IAM that are necessary to be successful in your efforts.  However, the greatest resource that you have is each other as you continue to reach out and communicate with your Sisters and Brothers about the many promises made by Delta that we now see firsthand they had no intention of keeping.


We encourage you and your leaders to develop a new structure that will provide the best representation to all the employees at the new Delta, once our ongoing efforts prove successful.
